Welcome to The Wild Canvas. These Terms and Conditions ("Terms") govern your use of our website and the purchase of art prints through our online store. By accessing or using this website, creating an account, or placing an order, you agree to be bound by these Terms in full.

Please read these Terms carefully before using our website. If you do not agree with any part of these Terms, you must not use our website or purchase our products.

Our website is operated from the Netherlands. These Terms are governed by Dutch law and comply with applicable European Union consumer protection regulations, including the EU Consumer Rights Directive and the General Data Protection Regulation (GDPR).

2. About Us

The Wild Canvas sells original art prints directly to consumers, including both limited-edition and open-edition prints. By purchasing from us, you are acquiring a physical artwork under the conditions set out in these Terms.

3. User Eligibility and Account Registration

3.1 Eligibility

To create an account and make purchases on our website, you must:

• Be at least 18 years of age, or have the consent of a parent or legal guardian;
• Provide accurate, current, and complete information during registration;
• Have the legal capacity to enter into a binding contract.

 

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately if you suspect any unauthorised use of your account.

We reserve the right to suspend or terminate your account if we believe you have violated these Terms or provided false information.

4. Products and Availability updated

4.1 Limited-Edition Prints

Limited-edition prints are produced in a fixed, numbered run. Each print is individually numbered (e.g. 3/50) and accompanied by an edition certificate confirming its authenticity and place in the edition. Once an edition is sold out, no further copies will be produced. The total edition size is stated on each product page.

 

4.2 Open-Edition Prints

Open-edition prints are not restricted to a specific print run and may be reprinted over time. They are not individually numbered and do not come with an edition certificate. Open-edition prints are clearly labelled as such on their product pages.

4.3 Product Descriptions and Accuracy

Product images on our website are as accurate as possible, but colours and textures may vary slightly due to monitor settings and printing processes. These variations do not constitute a defect. Any materials, paper type, print size, or finish details are described on the relevant product page.

4.4 Availability

All products are offered subject to availability. We reserve the right to discontinue any product at any time. If a product you have ordered becomes unavailable after your purchase, we will contact you promptly and offer a full refund.

5. Orders and Payment

5.1 Placing an Order

By placing an order through our website, you make an offer to purchase the selected product(s). Your order is confirmed when you receive an order confirmation email from us. We reserve the right to refuse or cancel any order, including after confirmation, in cases of pricing errors, suspected fraud, or stock issues.

5.2 Pricing

All prices are displayed in Euros (EUR) and include applicable VAT (BTW) where required by Dutch law. Shipping costs are shown separately during checkout before you confirm your order.

 

We reserve the right to change prices at any time. The price applicable to your order is the price shown at the time you place your order.

5.3 Payment

Payment is due in full at the time of placing your order. We accept payment via the methods listed at checkout. All transactions are processed securely. We do not store your full payment card details.

6. Shipping and Delivery

We aim to dispatch orders within the timeframe stated on our product pages. Delivery times are estimates and may vary depending on your location and carrier performance.

Risk of loss and title for products pass to you upon delivery. We are not responsible for delays caused by customs, postal services, or other events outside our control.

If your order arrives damaged, please contact us within 14 days of receipt with photographic evidence. We will arrange a replacement or refund at our discretion.

 

7. Right of Withdrawal (Returns and Refunds)

7.1 Your Right to Cancel

Under the EU Consumer Rights Directive, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason. To exercise this right, you must inform us of your decision to cancel within this 14-day period by contacting us at info@wildcanvas.org.

 

7.2 Exceptions

Please note that the right of withdrawal does not apply to:

• Personalised or custom-made prints created specifically for you;
• Prints that have been clearly specified as non-returnable due to their limited-edition nature, if this was clearly communicated at the time of purchase.

7.3 Return Process

If you exercise your right to cancel, you must return the product in its original condition and packaging within 14 days of notifying us. Return shipping costs are your responsibility unless the item is faulty or was sent in error.

We will process your refund within 14 days of receiving the returned product, using the same payment method used for the original transaction.

 

8. Intellectual Property and Artwork Protection updated

8.1 Ownership of Copyright

All artworks sold by The Wild Canvas are original works created by the artist. The copyright in all artworks, images, designs, and associated content on this website remains exclusively with The Wild Canvas and/or the original artist at all times. This copyright is protected under Dutch law (Auteurswet), EU copyright law, and international copyright conventions including the Berne Convention.

 

8.2 What You Own When You Buy a Print

Purchasing a print — whether limited-edition or open-edition — grants you ownership of the physical artwork only. It does not transfer, assign, or license any intellectual property rights, including but not limited to:

• The right to reproduce the artwork in any form or medium;
• The right to scan, photograph, or digitise the artwork for distribution;
• The right to create derivative works, adaptations, or edits based on the artwork;
• The right to use the artwork for commercial purposes, including advertising, merchandise, or resale of reproductions;
• The right to publish or display the artwork publicly online or in print without attribution and our prior written consent.

 

8.3 Prohibited Uses

Without our prior written consent, you must not:

• Copy, scan, or reproduce the artwork in any physical or digital format;
• Upload, share, or distribute images of the artwork on websites, social media, or other platforms in a way that misrepresents ownership or authorship;
• Use the artwork or any image of it for commercial gain, including print-on-demand services, merchandise, NFTs, or any other commercial application;
• Remove, alter, or obscure any artist signature, watermark, edition number, or certificate of authenticity associated with the artwork.

 

8.4 Personal and Social Sharing

You are welcome to share photographs of your purchased print on personal social media accounts for non-commercial purposes, provided that you clearly credit The Wild Canvas and/or the artist by name, and do not crop or alter the image in a way that removes attribution.

 

8.5 Website Content

All content on our website — including artwork images, photography, text, logos, and design — is protected by copyright. You may not reproduce, scrape, download, or reuse any content from our website without our express written permission.

 

8.6 Infringement

We actively monitor for unauthorised reproduction of our artworks. Any infringement of our intellectual property rights may result in legal action under Dutch and EU law. If you become aware of any unauthorised use of our artwork, we encourage you to notify us at info@wildcanvas.org.

 

9. Newsletter Subscription

You may choose to subscribe to our newsletter to receive updates about new print releases, promotions, and news. Subscribing is entirely optional and separate from your account registration.

By subscribing, you consent to receive marketing emails from us. You may unsubscribe at any time by clicking the "unsubscribe" link in any newsletter email, or by contacting us at info@wildcanvas.org. We will process your unsubscribe request promptly.

10. Privacy and Data Protection

We take your privacy seriously and process your personal data in accordance with the General Data Protection Regulation (GDPR) and Dutch privacy law (AVG).

We collect and process personal data such as your name, email address, delivery address, and purchase history solely to process your orders, manage your account, and (if you have opted in) send you our newsletter.
